GENERAL TERMS AND CONDITIONS OF THE BIOAURA.CZ ONLINE STORE

I. Basic Provisions

  1. These terms and conditions ("Terms") of Egida Plus s.r.o., ID No.: 25726200, VAT No.: CZ25726200, with registered office at Křížová 3112, 15000 Prague 5, registered with the Municipal Court in Prague, Section C, Insert 64659 ("Seller") govern the mutual rights and obligations between the Seller and a natural person who concludes a purchase contract outside their business activity as a consumer or within their business activity ("Buyer") through the online store www.bioaura.cz.

  2. These Terms form an integral part of the purchase contract. Any individual arrangements in the purchase contract take precedence over these Terms.

II. Information About Goods and Prices

  1. Information about products, including prices and main characteristics, is provided in the online store. Prices include VAT.

  2. All product presentations in the catalog are for informational purposes only and do not constitute a binding offer under Section 1732 (2) of the Civil Code.

  3. The Seller reserves the right to reject a contract, especially in the case of an obvious pricing error or product unavailability.

III. Orders and Contract Formation

  1. Orders can be placed using the online form or by email. Orders cannot be placed by phone for technical reasons.

  2. The purchase contract is concluded upon confirmation of the order by the Seller.

  3. All orders are binding unless canceled before shipping.

IV. Payment Terms and Delivery

  1. Buyers may pay by bank transfer, card, via Comgate, cash on delivery, or in person at the store.

  2. Shipping costs are stated during the order process. If a shipment is not accepted, the Buyer is liable for repeat delivery costs.

  3. Ownership passes to the Buyer only after full payment of the purchase price.

V. Withdrawal From the Contract

  1. The Buyer – consumer has the right to withdraw from the contract within 14 days of receiving the goods.

  2. However, the Buyer cannot withdraw from the contract if the goods have been opened and cannot be returned for hygienic reasons (e.g., cosmetics, food supplements, personal hygiene products) under Section 1837 of the Civil Code.

  3. Returned goods must be complete, undamaged, unused, and in their original packaging. Shipping costs are non-refundable.

  4. Withdrawal may be submitted via email or the sample withdrawal form.

VI. Liability for Defective Performance

  1. The Seller is liable for defects at the time of delivery and for defects that appear within 24 months unless the goods are of a shorter lifespan.

  2. Complaints are processed within 30 days. The Buyer will be notified of the outcome via email.

  3. In the case of a justified complaint, the Buyer is entitled to repair, replacement, discount, or contract cancellation.

VII. Products From Non-EU Markets ("NONEU")

  1. Some products are sourced from outside the EU and do not have a responsible person assigned in accordance with Regulation (EC) No. 1223/2009 on cosmetic products.

  2. These products are intended exclusively for the personal use of the end customer.

  3. In such cases, Bioaura.cz acts as a facilitator of the purchase and transport of original goods and is not the responsible person under EU law.

  4. Documentation, language localization, and availability may be limited for such products.

VIII. Shipping and Damaged Parcels

  1. The customer is obliged to check the condition of the parcel upon receipt. If visibly damaged, we recommend refusing the delivery and filing a damage report with the carrier.

  2. The complaint period for damaged parcels is 2 working days.

  3. Parcels sent cash on delivery will not be accepted.

IX. Out-of-Court Dispute Resolution

  1. Consumer disputes may be resolved out-of-court by the Czech Trade Inspection Authority: www.coi.cz, https://adr.coi.cz.

  2. The EU Online Dispute Resolution platform: http://ec.europa.eu/consumers/odr

X. Final Provisions

  1. Legal relationships are governed by Czech law. The purchase contract and terms are stored in electronic form.

  2. The customer agrees to the processing of personal data for the purpose of contract fulfillment and order dispatch.

  3. These terms may be amended unilaterally. Effective from: May 5, 2025.
